Section Sch1-35 — Resource Management Act 1991: Access to material incorporated by reference

35 Access to material incorporated by reference (1) The local authority— (a) must make the material referred to in subclause (2) ( material ) available for inspection during working hours at the offices of the local authority; and (b) must make copies of the material available for purchase in accordance with section 36 at the offices of the local authority; and (c) may make copies of the material available in any other way that the chief executive of the local authority considers appropriate in the circumstances (for example, on an Internet website maintained by or on behalf of the local authority); and (d) must give public notice stating that— (i) the material is incorporated in the plan or proposed plan; and (ii) the material is available for inspection during working hours free of charge and the place at which it can be inspected; and (iii) copies of the material can be purchased and the place at which they can be purchased; and (iv) if copies of the material are available under paragraph (c) , details of how and where it may be obtained or accessed. (2) The material referred to in subclause (1) is— (a) material incorporated by reference in a plan or proposed plan: (b) any amendment to, or replacement of, that material that is incorporated in the plan or proposed plan or the material referred to in paragraph (a) with the amendments or replacement material incorporated: (c) if the material referred to in paragraph (a) or paragraph (b) is not in an official New Zealand language, as well as the material itself, an accurate translation in an official New Zealand language of the material. Part 3 (comprising cls 30 to 35) was inserted, as from 10 August 2005, by section 129(1) Resource Management Amendment Act 2005 (2005 No 87).
