Section 79 — Senior Courts Act 2016: General powers

79 General powers (1) On an appeal in a proceeding that has been heard in a New Zealand court, the Supreme Court— (a) may make any order or grant any relief that could have been made or granted by that court; and (b) even if the proceeding has not been heard in the Court of Appeal, has the powers the Court of Appeal would have if hearing the appeal. (2) In a proceeding, the Supreme Court may, as it thinks fit, make— (a) any ancillary order; and (b) any order or decision on an interlocutory application; and (c) any order as to costs.
