Section 161 — Sentencing Act 2002: Custody of child or young person pending hearing

161 Custody of child or young person pending hearing Section 238 of the Children, Young Persons, and Their Families Act 1989 is amended by inserting, after subsection (1) , the following subsections: “ (1A) Subsection (1) is subject to subsection (1B). “ (1B) Subject to section 239(3), if a young person appears before a Youth Court the Court may, instead of dealing with the young person in any of the ways described in subsection (1), order that the young person be remanded to a penal institution. “ (1C) If the Court makes an order under subsection (1B), section 171(1) of the Summary Proceedings Act 1957 applies as if the Youth Court were a District Court. ”
