Section 174 — Sentencing Act 2002: Duties of probation officers

174 Duties of probation officers (1) Section 125 of the Criminal Justice Act 1985 is amended by repealing subsection (1) , and substituting the following subsection: “ (1) It is the duty of every probation officer— “ (a) to supervise all persons placed under the officer's supervision under a sentence of supervision or a release under subpart 2 of Part 1 of the Parole Act 2002, and to ensure that the conditions of the sentence or of the release are complied with: “ (b) to arrange and administer the sentences of supervision and community work referred to the officer for such administration, and to ensure that the sentences are carried out: “ (c) to co-ordinate and arrange community involvement (including the use of volunteers) in the administration of any particular community-based sentence, or any particular release under subpart 2 of Part 1 of the Parole Act 2002, where appropriate and in accordance with any instructions issued by a controlling officer: “ (d) to arrange and monitor and provide rehabilitative and reintegrative courses or counselling or personal services directed at the social reintegration of offenders and the reduction of the likelihood of reoffending, where appropriate, and in accordance with any instructions issued by a controlling officer: “ (e) to provide all the reports and information that the court, or the New Zealand Parole Board, or a Superintendent of a penal institution may require under any of the provisions of the Sentencing Act 2002 or the Parole Act 2002 or any other enactment: “ (f) to perform any other duty that is prescribed by or under this Act or any other enactment. ” (2) Section 125 of the Criminal Justice Act 1985 is amended by repealing subsections (2) and (3) . (3) Section 125(4) of the Criminal Justice Act 1985 is amended by omitting the words “ periodic detention ” wherever they occur, and substituting in each case the words “ community work ” . (4) Section 125(4) of the Criminal Justice Act 1985 is amended by omitting the words “ periodic detention centre ” , and substituting the words “ community work centre ” . (5) Section 125(4) of the Criminal Justice Act 1985 is amended by repealing paragraph (d) , and substituting the following paragraph: “ (d) to report to the controlling officer in the officer's probation area on the matters specified in paragraphs (a) to (c) and on any other matter relating to community work that he or she thinks fit. ”
