Section 205 — Social Security Act 2018: Refugee or protected person status

205 Refugee or protected person status (1) This section applies if MSD is satisfied that a person ( P ) is any of the following: (a) a person lawfully present in New Zealand who is awaiting the outcome of the person’s claim for recognition as a refugee or a protected person: (b) a person who is recognised as a refugee or protected person: (c) a person applying for a residence class visa under the Immigration Act 2009 who is compelled to remain in New Zealand because of unforeseen circumstances. (2) MSD may grant P— (a) an emergency benefit under section 63 : (b) temporary additional support under section 96 . (3) This section overrides section 16 (residential requirement) and section 19 (general limitation on receiving benefit: persons unlawfully resident or present in New Zealand and persons holding temporary entry class visa).
