Section Sch10-39 — Social Security Act 2018: Right to benefits

39 Right to benefits (1) A resident is not disentitled from obtaining a benefit (as defined in Schedule 2 of the Social Security Act 2018). (2) For the purpose of calculating the benefit, the resident is taken to be a patient in a hospital (within the meaning of, as the case requires, sections 206 and 207 and Schedule 2 of that Act, or section 19(1) of the New Zealand Superannuation and Retirement Income Act 2001) for more than 13 weeks.
