12 How annual income calculated (1) A person’s annual income, for the rate of benefit, or as referred to in a specified provision, is (unless the context otherwise requires) the person’s estimated income for the 52 weeks commencing on the date on which the benefit (if granted, or regranted) will commence. (2) The estimated annual income for the 52 weeks specified in subclause (1) is an amount equal to the income received by the person for the 52 weeks ending on the day preceding the date on which the benefit, if granted or regranted, will commence as MSD determines.
