Section Sch8-3 — Social Security Act 2018: Extraordinary vacancies

3 Extraordinary vacancies (1) A member may at any time be removed from office by the Governor-General for all or any of the following, proved to the Governor-General’s satisfaction: (a) inability to perform the functions of the office: (b) bankruptcy: (c) neglect of duty: (d) misconduct. (2) A member may at any time resign office by written notice to the Minister. (3) If a member’s office becomes vacant by death, resignation, or removal from office, the vacancy so created must be filled in the way in which the appointment to the vacant office was originally made. (4) Every person appointed to fill an extraordinary vacancy holds office for the rest of the term for which that person’s predecessor would have held office if the vacancy had not occurred. (5) The authority’s powers are not affected by a vacancy in its membership. Compare: 1964 No 136 s 12C
