146 Trustee may give undertakings for purposes of ADR settlement or arbitration agreement and any arbitral award Despite section 33 (duty not to bind or commit trustees to future exercise of discretion), a trustee may, for the purposes of an ADR settlement or arbitration agreement and any arbitral award under that agreement, give binding undertakings in relation to the trustee’s future actions as trustee.
