Section 153 — Trusts Act 2019: Application to Public Trust for investigation of condition and accounts of trust property

153 Application to Public Trust for investigation of condition and accounts of trust property (1) A trustee or a beneficiary of a trust may apply to Public Trust for the conduct of an investigation of the condition and accounts of the trust property (unless the trustee is a trustee corporation). (2) However, Public Trust must not proceed with the application if— (a) an investigation of the trust property under this Part has been concluded in the previous 12 months (unless the applicant has been given the leave of the court to make the application); or (b) the court has ordered that an investigation must not proceed. (3) Before proceeding with the application, Public Trust may require the applicant to pay a deposit or give security for the costs of the investigation (including Public Trust’s charges).
