Capacity to make nationality application 49 After section 44 of the British Nationality Act 1981 (c. 61) (decisions involving discretion) insert— Waiver of requirement for full capacity 44A Where a provision of this Act requires an applicant to be of full capacity, the Secretary of State may waive the requirement in respect of a specified applicant if he thinks it in the applicant's best interests.
