Section 128 — Land Registration Act 2002: Rules, regulations and orders

Rules, regulations and orders 128 1 Any power of the Lord Chancellor or the Secretary of State to make rules, regulations or orders under this Act includes power to make different provision for different cases.

2 Any power of the Lord Chancellor or the Secretary of State to make rules, regulations or orders under this Act is exercisable by statutory instrument.

3 A statutory instrument containing—

a regulations under section 100(2), or b an order under section 100(3), 102 or 113, is to be laid before Parliament after being made.

4 A statutory instrument containing—

a land registration rules, b rules under section 121, , ... c . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . d an order under section 5(1), 62(9), 80(4), 118(1) or 130, , or e regulations under paragraph 3(3) or 5(2) of Schedule 4A. is subject to annulment in pursuance of a resolution of either House of Parliament.

5 Rules under section 93 or paragraph 1, 2 or 3 of Schedule 5 shall not be made unless a draft of the rules has been laid before and approved by resolution of each House of Parliament.
