Section 152 — Nationality, Immigration and Asylum Act 2002: Arrest by immigration officer

Arrest by immigration officer 152 The following shall be inserted after section 28A of the Immigration Act 1971 (c. 77) (arrest without warrant)— Arrest with warrant 28AA 1 This section applies if on an application by an immigration officer a justice of the peace is satisfied that there are reasonable grounds for suspecting that a person has committed an offence under—

a section 24(1)(d), or b section 8 of the Asylum and Immigration Act 1996 (c. 49) (employment: offence).

2 The justice of the peace may grant a warrant authorising any immigration officer to arrest the person.

3 In the application of this section to Scotland a reference to a justice of the peace shall be treated as a reference to the sheriff or a justice of the peace.
