WHEREAS the [NAME] (the Board) has received an application for certification pursuant to section 24.1 of the Canada Labour Code (the Code ) from the applicant seeking certification as bargaining agent for a unit of employees of [COMPANY] (the employer); AND WHEREAS the employer has voluntarily recognized the applicant as bargaining agent for the proposed bargaining unit, and the parties are bound by a collective agreement that expires on July 31, 2029; AND WHEREAS the applicant and the employer agreed that the application concerns the bargaining unit to which the collective agreement applies, or substantially the same unit; AND WHEREAS the parties agree on a bargaining unit description comprising: all unlicensed employees of [COMPANY] working on Canadian-flagged vessels owned or bareboat chartered by [COMPANY].
