Section 107.5 — Competition Act: Aggravating or mitigating factors

Any evidence of the following shall be taken into account in determining the amount of an administrative monetary penalty under section 107.3: the frequency and duration of the conduct; the vulnerability of the class of persons likely to be adversely affected by the conduct; the financial position of the person against whom the order is made; the history of compliance with this Act by the person against whom the order is made; and any other relevant factor.
