Section 128 — Criminal Code: Misconduct of officers executing process

Every peace officer or coroner is guilty of an indictable offence and liable to imprisonment for a term of not more than two years or is guilty of an offence punishable on summary conviction who, being entrusted with the execution of a process, intentionally misconducts himself in the execution of the process, or makes a false return to the process.
